PRIVACY POLICY AND COOKIES

I. INTRODUCTION

The privacy policy aims to inform you properly about matters related to the processing of personal data. Therefore, in this document, we provide information about the legal bases for processing personal data, the methods of collecting and using them, the rights of data subjects, and various other information required by Articles 13 and 14 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons about the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. The document also contains information about the use of cookies and similar technologies.

II. DEFINITIONS

Whenever the following terms are used in the Privacy and Cookies Policy, they should be understood as defined below, unless the context of their use indicates otherwise:

Personal data (data): all information about an identified or identifiable natural person by one or more specific factors determining the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person, including the IP address of the device, location data, and internet identifier;

Processing: means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation, or alteration, retrieval, consultation, use, disclosure;

GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (EU Official Journal L 119/1 of 4 May 2016 and EU Official Journal L 127/2 of 23 May 2018);

Pseudonymization: means the processing of personal data in such a way that the data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data are not attributed to an identified or identifiable natural person;

Website (Site): a website operating at www.gamp-group.com;

User: any natural person visiting the Website or using its functionalities. 

III. DATA CONTROLLER

The data controller, responsible for determining the purposes and means of processing, is GAMP Sp. z o.o. with its registered office in Zielona Góra at Al. Konstytucji 3-go Maja 8, 65-803 Zielona Góra, registered under the KRS number 0000186894, NIP 9291712163 (hereinafter: the Controller). You can contact the Controller at:

V. CATEGORIES OF PERSONS PROCESSED ON THE WEBSITE

As part of the operation of the Website, the data of Website Users are processed.

VI. SCOPE OF DATA PROCESSED ON THE WEBSITE

The scope of data processed by the Controller may vary depending on which services or functionalities are provided through the Website you use. We receive your personal data from you when you browse the content of the Website. Some information about you may be automatically collected by external tools we use (Google Analytics 4). To help you understand what personal data we have, below, we have included information about the categories of personal data we process, divided by the purposes of their processing.

 

As part of analytical tools such as Google Analytics 4, we have access to information that, in our assessment, does not constitute personal data because it does not allow us to identify you and connect it to typical personal data. Out of caution, in case these pieces of information are treated as personal data by a supervisory authority, they are included in the description of personal data processing.

 

The information collected by us through Google Analytics 4 includes, in particular:

  • Your gender,
  • Age range in which you fall,
  • Your approximate location is limited to the locality.
  • Your interests based on online activity
  • Information about the operating system and web browser,
  • The source from which you access the Website,
  • Viewed subpages,
  • Time spent on the Website,
  • Transitions between individual subpages,
  • Clicks on specific links.
 
 
This information may also be used by the Google Analytics 4 provider for the provision and improvement of services, management of services, development of new services, fraud, and abuse prevention, and customization of content and ads displayed on various services, websites, and applications. The Google Analytics 4 provider processes this information based on its terms of service and privacy policy.
 
  1.  Website Users
 
Administration of the website, including ensuring security and handling technical issues
 
1. We do not seek to identify Website Users. However, we may process your data in connection with the administration of the website, including ensuring the security of services provided electronically through their acquisition and registration on the server. In this case, we collect data such as IP address, software and hardware parameters you use, configurations of your device (information about your website traffic, including the use of network communication protocols), information about viewed pages, and data from cookies.
 
Contact handling
 
1. When using the contact form, we process contact data that is necessary for handling correspondence sent to us, such as name, email address, phone number (if you choose to provide it), and any other data contained in the correspondence sent to us.
 
Analysis and statistics (Google Analytics 4)
 
1. Your data may also be processed for analytical and statistical purposes. For these purposes, we will primarily use information about your activity on the Website. We use the Google Analytics 4 tool, which automatically collects information about your use of the Website. IP address anonymization is enabled as part of the Google Analytics 4 service, which means that your IP address is hidden before it is passed on to the service provider (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland).

VII. PURPOSES, LEGAL BASIS FOR PROCESSING, AND DATA RETENTION PERIOD

Depending on how you use the Website, there are different purposes and legal bases for processing your data by the Controller, as well as retention periods. Below, we provide information about possible purposes for processing your data, the legal bases for such processing, and data retention periods. After the specified period, we will not use the data for the specified purpose. However, this does not mean that we will delete them in every case; they may be stored for a period allowed by the law to enable the pursuit or defense against claims.

 

1. Website Administration, Including Ensuring Security and Handling Technical Issues

The Controller may process your data when it is necessary to administer the website, including ensuring the security of services provided electronically by acquiring and registering them on the server.

  • Legal basis for data processing: Article 6(1)(f) of the GDPR – the legitimate interest of the Controller, consisting of ensuring the security of Website users and handling technical issues
  • Data retention period: Server log files are stored indefinitely as auxiliary material for administering the Website. The information contained in them is not disclosed to anyone except those authorized to administer the server and the network.
 
2. Handling Contact Using the Contact Form
The Controller processes data of individuals using the contact form on the Website.

Legal basis for data processing:
  • Article 6(1)(a) of the GDPR – your consent to process data for handling inquiries
  • Article 6(1)(f) of the GDPR – the legitimate interest of the Controller, including:
    • contacting potential customers and building positive relationships based on honesty and loyalty;
    • establishing, pursuing, and defending against claims.
 
Sometimes the legal basis is also Article 6(1)(b) of the GDPR, meaning the preparation and execution of a contract or legal provisions under Article 6(1)(c) of the GDPR.
 
Data retention period: Until all processing purposes expire or effective objection is raised. The legal basis for processing is consent until consent is withdrawn or the purpose of processing expires.
 
3. Analytical and Statistical Purposes (Google Analytics 4)
 
The Controller may process your data for analytical and statistical purposes to conduct activity analysis, improve functionalities, and enhance the quality of services provided.

Legal basis for data processing: Article 6(1)(f) of the GDPR – the legitimate interest of the Controller, consisting of creating statistics and analyzing them to improve the Website
 
Data retention period: For the period of data retention collected through Google Analytics 4 – 26 months. 

VIII. USER RIGHTS

Website Users have the following rights:

  1. Right to access data content – this right allows the User to access their data processed by us as the Data Controller. This right can be exercised by sending an email to iod@gamp.pl.
  2. Right to change personal data – this right allows the User to change and update their personal data processed by the Data Controller. This right can be exercised by sending an email to iod@gamp.pl.
  3. Right to obtain a copy of data – this right allows the User to obtain a copy of their personal data. This right can be exercised by sending an email to iod@gamp.pl.
  4. Right to withdraw consent – this right applies when personal data is processed based on consent. The User has the right to withdraw their consent at any time. This right can be exercised by sending an email to iod@gamp.pl.
  5. Right to restrict processing – this right allows the User to restrict the processing of their personal data in cases such as:
 
a) when you question the accuracy of your data – the Controller will restrict processing for a period allowing them to verify the accuracy of the data;
b) when the Controller processes your data unlawfully, and you oppose their deletion, you can request the restriction of their processing instead;
c) when the Controller intends to delete your data because they are no longer needed, you can request the restriction of their processing if they are necessary for establishing, exercising, or defending legal claims. To establish the right to restrict processing, the Controller will ask you to demonstrate that they are indeed needed for establishing, exercising, or defending legal claims;
d) when you object to the processing of your data based on the legitimate interests of the Controller – Article 6(1)(f) of the GDPR (you will receive information on the legal basis for processing when your data is collected), until it is determined whether the Controller’s legitimate interests outweigh the grounds for objection.
 
This right can be exercised by sending an email to iod@gamp.pl.
     6. Right to object to the processing of personal data – this right always applies when we process your data for marketing purposes. If we process your data for marketing purposes, you do not need to justify your objection. If you object to other processing purposes based on the legitimate interests of the Controller – Article 6(1)(f) of the GDPR, you can object to the processing of your personal data for reasons related to your particular situation. This right can be exercised by sending an email to iod@gamp.pl.
     7.  Right to data portability – this right can be used for data processing in computer systems, provided the data is processed based on the consent of the data subject or under a contract. This right applies only to data provided by the individual or collected from the individual. This right can be exercised by sending an email to iod@gamp.pl
     8. Right to request data erasure
 
This right is also known as the “right to be forgotten.” This right applies to Users in the following cases:
 
a) personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
b) you have withdrawn the consent on which the processing is based, and there is no other legal ground for the processing;
c) you have objected to the processing of your personal data, and there are no overriding legitimate grounds for the processing;
d) your personal data has been processed unlawfully;
e) personal data must be erased to comply with a legal obligation in Union or Member State law to which the Controller is subject;
f) personal data has been collected about the offer of information society services as referred to in Article 8(1) of the GDPR.

      9. Right to complaint – individuals whose personal data is processed by the Data Controller also have the right to complaint to the supervisory authority regarding the improper processing of their personal data. The supervisory authority is the President of the Office for the Protection of Personal Data, with its registered office at Stawki 2, 00-193 Warsaw. However, we hope that you will allow us to clarify the matter before submitting a complaint.

IX. DATA RECIPIENTS

If you are a User of the Website, your data may be disclosed to:

a) entities authorized to obtain personal data under the law;

b) legal services.

 

If you contact us through the contact form, your data may be disclosed to:

a) entities authorized to obtain personal data under the law;

b) legal services;

c) other entities, including other companies within the GAMP Group, if necessary for handling your contact.

 

The GAMP Group includes GAMP Sp. z o.o. Zielona Góra, Poland; GAMP GmbH Dresden, Germany; GAMP Ltd. Nuneaton, United Kingdom; GAMP Ltd. Alexandria, Egypt; GAMP Ltd. Izmir, Turkey.

Additionally, the Google Analytics 4 provider has access to data collected using this tool. 

X. TRANSFERRING DATA OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)

Google Analytics 4

We do not transfer personal data outside the EEA. However, we do provide information that is anonymous to us to the Google Analytics 4 service provider (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). The information we process in connection with the use of this tool is described in Chapter VI, Scope of Data Processed on the Website. The use of this tool may involve the collection of information outside the EEA. We inform you that the service provider, Google Ireland Limited, confirms compliance with the privacy principles specified in the GDPR regarding the collection, use, and storage of personal data. XI. COOKIES AND SIMILAR TECHNOLOGIES

Cookies are small text information stored on your end device (e.g., computer, tablet, phone) that can be read by our teleinformatics system (first-party cookies) or teleinformatics systems of third parties (third-party cookies). Certain information can be stored and stored in cookie files, which teleinformatics systems can access for specific purposes. Some cookies are deleted at the end of the internet browser session, i.e., when it is closed (session cookies). Other cookies are stored on the end device and allow the browser to be recognized during the next visit to the website (persistent cookies). We use cookie files based on your consent, except in cases where cookies are necessary for the proper provision of electronic services to you.

During your first visit to our website, a message is displayed with information about the cookies used and information about the possibility of managing cookie settings (deciding which cookies you agree to and which you want to block).

The website uses first-party cookies to ensure the proper functioning of all its features. The website also uses third-party cookies to use external statistical and analytical tools. Information collected through these cookies is also processed by the tool provider – Google Ireland Limited, the provider of the Google Analytics 4 service.

We use cookie files to:

  • record whether you have consented to the use of cookies other than necessary ones;
  • customize the content of websites to the User’s preferences and optimize the use of the website, in particular, these files allow recognition of the User’s device and properly display the website tailored to their individual needs;

Google Tag Manager (GTM)

We use GTM to control services such as Google Analytics. GTM allows us to activate all tags from other companies based on your consent status, i.e., selected preferences regarding cookies and similar technologies.

GTM may collect aggregated data related to tag activation. This data does not include user IP addresses or any measurement identifiers associated with specific individuals. In addition to data from standard HTTP request logs, all of which are deleted within 14 days of receipt, and the diagnostic data mentioned above, Google Tag Manager does not collect, store, or provide any information about the visitors of our client’s services, including visited page URLs. XII. MANAGING COOKIES AND SIMILAR TECHNOLOGIES

1. In many cases, web browsing software (web browser) defaults to allowing the storage of cookies (and similar technologies) on the user’s end device. Users of the website can independently change the settings regarding cookies (and similar technologies) at any time. These settings can be changed, especially to block the automatic handling of cookies and similar technologies in the web browser settings or to receive notifications about their placement on the user’s end device.

2. Detailed information about the options and methods for managing cookies and similar technologies is available in the software settings (web browser). Failure to change settings related to cookies (and similar technologies) means that they will be placed on the user’s end device, and, consequently, we will store information on the user’s end device and access this information.

3. Web browsers also offer the option to use incognito mode. You can use it if you do not want information about visited pages and downloaded files to be saved in the browsing and download history. Cookies created in incognito mode are deleted when all windows of this mode are closed.

4. If you block the use of cookies, you may encounter situations where certain elements (functionalities) and conveniences of our website will cease to function.
